Terms of Service

These Terms of Service ("Terms") govern your use of the services provided by Innovint LLC ("we," "us," or "our"), including our web application, SMS messaging program, and related communication services. By using our services or by providing consent to receive SMS messages, you agree to be bound by these Terms.

1. Services

Innovint LLC provides AI-powered sales automation and follow-up communication services for new home sales. Our services include SMS messaging, email communications, and a web-based application for managing sales follow-up workflows.

2. Eligibility

You must be at least 18 years old to use our services. By using our services, you represent that you are at least 18 years of age and have the legal capacity to enter into these Terms.

3. SMS Messaging Terms and Conditions

3.1 Program Description

Innovint LLC operates a recurring SMS messaging program that sends follow-up communications to prospective home buyers who have visited new home builder model home communities. Messages are sent on behalf of the sales professional you met with and contain information relevant to your home buying journey.

3.2 Consent and Opt-In

By providing your phone number and verbal consent during an in-person visit to a model home community, you expressly agree to receive recurring automated SMS text messages from Innovint LLC at the phone number you provided. Your consent is not required as a condition of purchasing any property or service. You may revoke your consent at any time.

3.3 Message Frequency and Content

Message frequency varies. You may receive up to 4 messages per month. Messages may include:

  • Follow-up messages after visiting a model home community
  • Updates on home availability and pricing in communities you have visited
  • Appointment reminders and scheduling confirmations
  • Responses to your inquiries about new home communities
  • Community news and updates relevant to your home search

3.4 Message and Data Rates

Message and data rates may apply. Please consult your wireless carrier for details about your text messaging plan and any charges that may apply. Innovint LLC is not responsible for any charges incurred from your wireless carrier for receiving text messages.

3.5 Opt-Out Instructions

You may opt out of receiving SMS messages at any time by replying STOP to any message you receive from us. After opting out, you will receive a one-time confirmation message, and no further SMS messages will be sent to you. Opting out of SMS messages does not affect any other communications or services.

3.7 Privacy and Data Protection

We value your privacy. We will not sell, share, or disclose your mobile phone number or SMS opt-in consent data to any third parties or affiliates for marketing or promotional purposes. 3.8 Carrier Liability

Wireless carriers (including but not limited to AT&T, T-Mobile, Verizon, and others) are not liable for delayed or undelivered messages. Message delivery is subject to effective transmission from your wireless carrier and network availability. Innovint LLC does not guarantee message delivery.

3.9 Supported Carriers

Our SMS messaging service is available on all major U.S. wireless carriers. However, some carriers may not support all message types. Contact your carrier for details about text messaging capabilities.

4. User Accounts

Certain features of our services require a user account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

5. Acceptable Use

You agree not to:

  • Use our services for any unlawful purpose or in violation of any applicable laws or regulations.
  • Attempt to gain unauthorized access to our systems or other users' accounts.
  • Interfere with or disrupt the operation of our services.
  • Transmit any harmful code, viruses, or malicious software through our services.
  • Use our services to send unsolicited communications or spam.

6. Intellectual Property

All content, features, and functionality of our services — including but not limited to text, graphics, logos, software, and design — are owned by Innovint LLC and are protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works from our content without our express written permission.

7. Disclaimer of Warranties

Our services are provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that our services will be uninterrupted, error-free, or completely secure. We are not responsible for any delays or failures in message delivery caused by wireless carriers or other third parties.

8. Limitation of Liability

To the fullest extent permitted by law, Innovint LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of our services, regardless of the theory of liability.

9. Indemnification

You agree to indemnify and hold harmless Innovint LLC and its officers, directors, employees, and agents from any claims, losses, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of your use of our services or violation of these Terms.

10. Modifications

We reserve the right to modify these Terms at any time. We will notify you of any material changes by posting the updated Terms on this page with a revised "Last Updated" date. Your continued use of our services after any changes constitutes acceptance of the updated Terms.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Georgia, without regard to its conflict of law provisions.
